Can I enforce a non-compete agreement with an independent contractor?

A non-compete agreement's enforceability depends on the context, scope, and state in which you are operating. Generally speaking, a noncompete cannot be longer than two years, it must be restricted in geography and subject matter, and be "fair."

Savvi's non-compete agreement starts specific and then broadens in order to create the most protection possible without being subject to a void declaration. For example, if a noncompete stated that the contractor could not work with another company in a related field for the entirety of the United States, and your company only has business in one state, then that non-compete clause, or perhaps the entire contract, would be too broad and not enforceable.
